Project: Case Closures (NFA) Under NJDEP Cleanup Star Program

Description: The New Jersey Department of Environmental Protection (NJDEP) Cleanup Star Program allows EWMA’s Cleanup Stars to perform all the site investigatory and/or remedial activities and complete the necessary paper work required to gain a NJDEP No Further Action (NFA) declaration letter in a highly expedited timeframe, usually within ten (10) business days.
Two Recent Cleanup Star Success Stories:

An industrial/commercial property in New Jersey triggered the Industrial Site Recovery Act (ISRA) as a result of the sale of the property. A previously performed Phase I identified several areas of environmental concern (AOCs); however, no more than two (2) of the AOCs required further investigation, qualifying the property for Clean Up Star closure. The property was owned by a single entity; however, there were three (3) tenants occupying the property. Per the NJDEP, a General Information Notice (GIN) and a Negative Declaration Affidavit were necessary for each of the three (3) tenants, but only one site-wide Preliminary Assessment Report (PAR) needed to be submitted, provided it described all operations conducted by all three tenants on the property. EWMA streamlined all three (3) tenants into one (1) PAR, saving time and expenses for the client. Once the proper ISRA investigations were completed, the results were submitted along with the required Clean Up Star application to the NJDEP Clean Up Star Program. EWMA’s Cleanup Star closure request was granted a NO FURTHER ACTION (NFA) letter from NJDEP within five (5) business days of the submittal.

A real Estate broker called on us to save a deal from falling apart due to environmental issues; the broker made it very clear to us that the closing date could not be delayed or the deal would fall through. A homeowner in New Jersey was selling her house. As part of the contract with the buyer she had to remove a pre-existing Underground Storage Tank (UST) from the property. When the tank was removed there was evidence of soil contamination (there had been a petroleum release from the tank). Fortunately for all parties concerned, the release had only impacted soils and not ground water, and therefore the project qualified for closure via the Cleanup Star Program. EWMA removed the contaminated soils and submitted all of the appropriate Cleanup Star paperwork. The case qualified under the Cleanup Star Program and a NO FURTHER ACTION (NFA) letter was faxed to us within four (4) business days of submittal to NJDEP. The real estate transaction was saved by EWMA's Cleanup Stars, and the closing was completed on time!
